The “Barebones x Paleblue Giveaway” (the "Giveaway") is sponsored by Barebones LLC, 215 Wilmington Ave #140, Salt Lake City, UT 84106 (the “Sponsor”). The Sponsor is responsible for all aspects of the Giveaway. Participation in the Giveaway constitutes the participant's full and unconditional agreement to these Official Rules, and Sponsor’s decisions, which are final and binding in all matters related to the Giveaway.
Eligibility
Giveaway (the "Giveaway") is only open to participants who are legal residents of the USA and who are 18+ at the time of entry (the “Entrant”). The Giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law, rule, or regulation.
Giveaway Period
Entries will be accepted online starting on 04/02/2024 at 12:00 AM (MST) and ends 04/17/2024 at 12:00 AM (MST) (the “Entry Period”). All online entries must be received by 04/16/2024 at 11:59 PM (MST) to be eligible. Entries submitted before or after the Entry Period will not be eligible. Sponsor’s instance of Shopify is the official timekeeping device for the Giveaway.
How to Enter
An email address must be submitted via www.barebonesliving.com for valid entry. No purchase necessary.
Judging
The Giveaway will be awarded based on random email selection via 3rd party random selection tool. Validation of winners will be conducted by Barebones staff.
Prizes
The approximate retail value of all three (3) prizes is $900. The prizes are:
1st Prize: $250 Barebones Gift Card, Barebones Outpost Lantern, Paleblue Home Conversion Kit, Paleblue Approach 3 Solar Charger, Paleblue Wall Adapter. (Approximate retail value: $500 USD)
2nd Prize: $100 Barebones Gift Card, Barebones Edison Mini Lantern, Paleblue Solar Power Kit, Paleblue Wall Adapter. (Approximate retail value: $250 USD)
3rd Prize: $50 Barebones Gift Card, Barebones Edison Mini, Paleblue Solar Starter Kit, Paleblue Wall Adapter. . (Approximate retail value: $150 USD)
Actual/appraised value may differ at time of prize award. The specifics of the prizes shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prizes are non transferable. Any and all prize related expenses, including without limitation any and all federal, state, and local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Barebones to use the winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
Winner Notification
Winners of the Giveaway will be notified via Instagram direct message, e-mail, or phone number they entered into the Giveaway within five (5) days following the winner selection. Barebones shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected. The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations.
Terms
Barebones reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Barebones may judge submissions from all eligible entries received prior to and/or after (if appropriate) the action taken by Barebones. Barebones reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions.
Barebones has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Giveaway rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Barebones reserves the right to seek damages from any such person to the fullest extent permitted by law.
Email Communications: By entering the Giveaway, participants agree to receive email newsletters periodically from Barebones and the partners contributing to the prize package. Participants acknowledge that their email addresses provided for entry may be used by Barebones for marketing communications, including promotional offers, product updates, and other relevant information. Participants retain the right to opt out of these communications at any time by clicking the unsubscribe link provided in the respective newsletters. Opting out of marketing communications will not affect participation in the Giveaway or eligibility to win prizes. Barebones is committed to respecting participants' privacy and will not share or sell email addresses to third parties for marketing purposes. Limitation of Liability
By entering you agree to release and hold harmless Barebones, Paleblue, and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error which may occur in the administration of the Giveaway or the processing of entries.
Disputes
THIS GIVEAWAY IS GOVERNED BY THE LAWS OF UNITED STATES AND UTAH, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and participant further waives all rights to have damages multiplied or increased.
